#OSD Announces News Conference to Address Unjust Arrest of Peaceful Protesters 
Violation of the US Constitution continues at Freedom Plaza

Monday, January 9, 2012 – Occupy San Diego will hold a Press Conference today at 3:30pm at Freedom Plaza (formally the San Diego Civic Center Plaza). The conference will focus on the targeted and unlawful application of the law against peaceful protesters, and the expansion of the Occupiers’ Federal TRO for an injunction to stop the false, arbitrary and overly broad charges of “Illegal lodging & encroachment” by the San Diego Police Department (SDPD).

Lawyers for OSD and unjustly arrested Occupiers Stephanie Jennings, Michael Garcia, Ray Lutz, and John B. Kenney will be in attendance, as well as other eye-witnesses and singers of the singing group, Outlaws Occupella SD Gang.

Occupy member and Occupella singer Stephanie Jennings is one of two women man-handled, bruised and arrested by SDPD officers for singing at Freedom Plaza on Saturday night, where several hundred Occupiers were peacefully celebrating the three month anniversary of the Occupy Movement. Ms. Jennings, a self-employed mother and founder of the Women Occupiers Group, was charged $10,000 for 243(B) PC, ” battery committed against the person of a peace officer.” Ms. Jennings, and numerous eye-witnesses deny the charges. She will be filing an formal complaint.

Michael Garcia was arrested Friday night for having a folding chair in the Plaza, just one hour before he was scheduled to speak at a labor event celebrating the 100th year anniversary of the Emma Goldman and Free Speech and Workers’ Rights History Event at the Centro Cultural Del Raza at Balboa Park.

A YouTube video of the incident shows SDPD officers arresting two women, and throwing one of them to the concrete Plaza floor. Many protesters can be heard chanting, “Shame on you,” at the SDPD officers man-handling the women.

Footage of Stephanie Jennings, picking up the action just after the initial assault and battery by the SDPD Sgt., is between 5 and 18 seconds on the left side of the screen. The same who assulted Ms. Jennings is seen later pushing another woman.

At 12:05am on December 22 a team of San Diego Police Department Officers march into the plaza and make three arrests. Alan, Chris, and Daniel, all protesters at Occupy San Diego. Chris was choked and Daniel was stomped on by the police in the video.


UPDATE: 7:09 AM PST, our occupy congress organizer Chris has posted bail. He’s just waiting to be released!

UPDATE: 7:39 AM PST “A friend of OSD just told me that the police continued to randomly grab one person at a time until most people were arrested and only 4 or 5 people remained at the Plaza. The exhausted few remaining need reinforcements.”

Identified: NYPD Officer Who Maced Peaceful Protesters

A photographer has identified the cruel and cowardly NYPD supervisor who point blank maced a penned in group of young women and then slinked away Saturday at the Occupy Wall Street protests:

I don’t know if you guys can see that well but those are the red marks on my wrists for being handcuffed for three straight hours today, with my hands twisted unnaturally behind my back. 
I decided to go to the wall street occupation in NYC and…
-was maced in the face while standing on a public sidewalk calmly asking an officer if I could continue walking. 
-was forcefully arrested (arms pulled behind my back by two police officers then lifted off the ground and dragged to a nearby wall) while being treated for the mace on my skin
-had my requests for information (whether I was being arrested or simply detained, why I was being arrested, whether they could read me my rights) greeted with silence by a wall of policemen standing with their nets, watching us sit there handcuffed. 
-was bused, as the cuffs got tighter and tighter, to police headquarters (along with about 80 other peaceful protesters) and made to wait in the van outside headquarters for another two and a half hours
-was detained inside a prison cell for about another 6 hours, again with barely any information about why I was arrested and for how long
-was told I could have a phone call but only if it was to a New York number, and then was subsequently ignored when I asked if I could use a phone book 
-was finally released with a charge of disorderly conduct and a court date nov 3
Right now I’m overwhelmed and exhausted. I missed the last train back to sarah lawrence because of being in fucking jail, so I’m staying at my friend’s dorm at parsons. I had just about every right I “have” violated tonight and it makes me really angry. when the police feel the need to use the amount of force they did on me - i’m 93 lbs and 4 ft - you know something’s off. when they’re detaining the “granny peace brigade” along with me, you know there’s really something off. this isn’t right, this isn’t democracy. that’s all I can say right now because I’m so fucking tired and I need to just go to bed. perhaps I’ll have some more coherent thoughts tomorrow, but again, right now I’m just totally overwhelmed. 

I was fucking pissed off when I heard about this, but then I saw the video footage of you being maced and I almost cried. What. The. Fuck. Where did all of this country’s justice go?

BASTARDS! I hope you’re feeling better now. I seriously hate how some policemen just think they can pretty much do what they want with the weapons they’ve got. Are we supposed to feel safe around them? Because I don’t think we do anymore.

I love how Westboro can do whatever the fuck they want, and people can protest abortion clinics all the fucking time, but peacefully protest Wall Street and police brutality is everywhere. I just get more and more ashamed of my country as the days go on. 

These stories need to be told. People need to listen. This isn’t okay.
